General Terms and Conditions of Sport Kessler GmbH for
- online bookings / online orders
- bookings/purchase on site (Sport & Mode Kessler, Walserstrasse 73, 6991 Riezlern)

I Preamble:
1. The following General Terms and Conditions apply to all services of Sport Kessler GmbH, contractually concluded via online shops on www.sport-kessler.com or www.snowcompany.at or by purchase/booking on site in the shop Sport & Mode Kessler, Walserstrasse 73, 6991 Riezlern, Austria.
2. By accepting the GTC & the right of cancellation when placing your order/purchasing on the Internet (online) or on site in the shop Sport & Mode Kessler, you confirm your details and your agreement with the GTC and the right of cancellation. A legally binding contract is concluded between Sport Kessler GmbH and the customer noted on the booking. All articles and services noted on the receipt are binding.
3. The language decisive for the conclusion of the contract is exclusively German. Translations of the GTC into other languages are for your information only. In the event of any changes to the GTC, please contact Sport Kessler GmbH.

II General provisions:
1. Conclusion of contract:

a. The presentation of goods and services in our online shops does not constitute a legally binding offer, but an invitation to order.
b. A booking / conclusion of a contract is concluded with the separate transmission of a booking confirmation / invoice in written form or by e-mail to the e-mail address you have provided after you have placed a completed order in our online shop or with the issue of a receipt on site by Sport Kessler GmbH. Please check the correctness of your details and inform us immediately of any changes. Any changes are only valid in written form. Verbal agreements are not valid.

2. collection, storage and processing of your personal data when booking / ordering online:

a. You can order goods and/or services in our online shop as a guest or as a registered user. As a registered user, you do not have to enter your personal data each time, but you can simply log in to your customer account before or during an order with your e-mail address and the password you freely chose when registering.
b. We need the following data from you to carry out and process an order:
i. First and last name
ii. Postal address
iii. E-mail address
iv. Any necessary data relating to body size, shoe size, weight, etc.
v. The corresponding data of sub-customers for whom you make bookings under the previous points
c. If you would like to create a customer account, we need the following data

3. terms of payment & prices for online bookings:

The purchase price is due immediately when the order is placed. Unless otherwise stated, the prices relate purely to the items shown in the description. The prices in the online shop only apply to online orders. Errors and price changes are reserved. The prices at the time of ordering apply.

Die Preise werden in EURO angezeigt, mit den entsprechenden Versandkosten ausgewiesen und sind dementsprechend zu bezahlen. Bei Buchungen im Internet fallen keine Zahlungs- bzw. Buchungsgebühren an.
b. Die Zahlung für Dienstleistungen (Verleihartikel, Kurse) sowie für Saisonkarten des Skigebiets Oberstdorf-Kleinwalsertal erfolgt direkt bei Buchung via Paypal, Kreditkarte oder Sofortüberweisung. Zahlungsabwickler ist Paypal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg bzw. hobex AG, Josef-Branstätter-Str. 2b, A-5020 Salzburg. Es gelten die im Internet angegebenen Preise zum Zeitpunkt der Buchung für die jeweilige Kategorie. Die Preis

4. right of cancellation/right of withdrawal:
a. Right of withdrawal when ordering sales items online:
i. The right of withdrawal is 14 days from the day,
1. on which you or a third party named by you, who is not the carrier, have taken possession of the goods;
2. when ordering several goods within a uniform order process: on the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods; or
3. in the case of a contract for the delivery of goods in several partial shipments or pieces, on the day on which you or a third party named by you, who is not the carrier, have taken possession of the last partial shipment or the last piece.

You must return the goods immediately and in any event no later than 14 days from the date on which you notify us of the cancellation of this contract to the return address below or return them to us there. The deadline is met if you send the goods before the 14-day period has expired.

Please enclose a copy of the invoice with the return shipment. After receipt of the goods, bank transfers will be credited back to the respective account!

If you would like an exchange, simply place a new order in our shop and the purchase price will be refunded on receipt of the return.

b. Rücktrittsrecht bei online Buchungen sowie Bestellung vor Ort von Verleihartikeln / Kursen:
i. Lt. $ 18 Abs. 1, Z2 , Z 10, Abs. 2, Abs. 3 FAAG besteht für Dienstleistungen im Bereich Freizeitbetätigungen kein Rücktrittsrecht, wenn der Vertrag einen spezifischen Termin oder Zeitraum für die Leistung vorsieht.
ii. In Abweichung davon und im Zuge des Kundenservices gilt für alle Buchungen, die auf den Homepages der Snowcompany sowie auf www.sport-kessler.com werden, folgendes Widerrufsrecht:
1. Wird eine Bestellung widerrufen, fallen grundsätzlich Verwaltungskosten (Kosten Zahlungsabwicklung & Systemgebühren) in Höhe von € 5,00 an.
2. Bestellungen können bis 8 Tage vor Leihbeginn kostenlos widerrufen werden (es fallen Verwaltungskosten in Höhe von € 5,00 an).

a. Warranty for purchases of goods:
i. If the goods purchased and delivered in our online shop are defective, you are entitled to demand subsequent performance, withdraw from the contract or reduce the purchase price within the framework of the statutory provisions.
b. Limitation of liability:
i. We are liable for intent and gross negligence. Furthermore, we are liable for the negligent breach of obligations whose fulfilment is essential for the proper execution of the contract, whose breach endangers the achievement of the purpose of the contract and on whose compliance you as a customer may regularly rely. In the latter case, however, we are only liable for foreseeable, contract-typical damage. We are not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.

6 Legal system and place of jurisdiction:

For all legal disputes in connection with your booking on the Internet, Austrian law shall apply exclusively. The language of negotiation for legal disputes is German. The place of jurisdiction is Vorarlberg, the competent court for the municipality of Mittelberg.

7. severability clause:

Should a provision of these GTC not be legally effective or become invalid, this shall not affect the validity of the remaining provisions. In this case, as well as in the event that a loophole becomes apparent, the invalid and unenforceable or missing provision shall be replaced by an appropriate provision which - as far as legally possible - comes closest to what the contracting parties intended or would have intended according to the economic sense and purpose of the agreement, if they had considered the point when concluding this agreement.

II Supplementary specific provisions for sales items: valid for orders on the Internet
1. retention of title: the goods remain our property until full payment has been made. if you are more than 10 days in arrears with payment, we have the right to withdraw from the contract and reclaim the goods.

2. terms of delivery: We deliver the goods in accordance with the agreements made with you. shipping costs incurred are listed in each case and are shown separately on the invoice. deliveries are possible to Germany or Austria.

3. transport damage: Please check the consignment immediately upon receipt for completeness and integrity. If the parcel is damaged, please make a complaint to the deliverer immediately. In this case, please also contact us by e-mail. You will receive a replacement for the damaged items from us immediately, provided they are still in stock. If you are entitled to claims against the carrier, you are already assigning your claims to us in full; we hereby accept your offer of assignment.

III Ergänzende spezifische Bestimmungen für Verleihartikel: gültig für Bestellungen im Internet und den Verleih vor Ort (Sport &Mode Kessler) von Ski, Wintersportartikeln sowie allen sonstigen Artikeln außer Mountain- & E-MTBikes, Klettersteigsets
1. Das Mietmaterial unterteilt sich in verschiedene Kategorien und Altersgruppen (Kinder/Jugendliche, Erwachsene). Die eigentliche Auswahl an Marken & Modellen des Verleihmaterials findet – auch bei erfolgter Buchung im Online Shop - vor Ort im Verleih statt.
2. Die Leihgegenstände müssen bei Leihbeginn mindestens gegen Bruch- & Beschädigung mit einer Schutzgebühr versehen werden. Ein Ausschluss ist nicht möglich. Bei allen Artikeln mit Schutzgebühr (Ski, Snowboard, LL-Ski) wird Ihnen dieser Betrag bei Buchung automatisch berechnet & separat ausgewiesen. Weist der Leihgegenstand bei Rückgabe einen nicht reparablen Schaden auf, so wird ein Selbstbehalt von 20% auf den Zeitwert verrechn

IV Supplementary specific provisions for rental items: valid for online orders and on-site rental (Sport &Mode Kessler) of mountain & e-MTBikes, via ferrata sets
1. BIKE protection fee: All bike prices include a protection fee of 10% for all repairable damage that is within the range of normal use of the bike. In the event of damage beyond this, the renter is liable for 20% of the repair costs. Riding in bike parks is not permitted with Sport Kessler rental bikes!
2. In the event of theft, the renter is liable for the current market value of the bike, which is calculated on the basis of the purchase value and previous rental transactions.
3. The road traffic regulations must be observed.
4. Rental items must be returned on the last day of rental by no later than:

5. via ferrata equipment: We expressly point out that any liability in connection with the use of the via ferrata equipment is excluded. The borrower releases Sport Kessler GmbH and its employees from any liability and assures to indemnify and hold us and our employees harmless in the event of damage.
The equipment was taken over in perfect condition.
The correct and appropriate use, application and handling as well as the assessment of the difficulties in the terrain, the via ferrata itself, the objective alpine dangers & the subjective dangers of mountaineering are the responsibility of the borrower.
If the shock absorber of the via ferrata set is triggered, a flat rate of € 75.00 will be charged per triggered shock absorber.
By signing the rental voucher, the borrower also assumes responsibility for the safety of the equipment when renting several pieces of equipment.

V Supplementary specific provisions for the purchase of season tickets of IG Skipass Oberstdorf-Kleinwalsertal
1. Data protection: Declaration of consent
For the purchase of season tickets of IG Skipass Oberstdorf-Kleinwalsertal, you confirm your consent to the following data protection declaration upon completion of the order:
I agree that my address data and photographs may be collected, processed and used by the member companies of Allgäu-Tirol-Bergwelt GmbH and OBERSTDORF - KLEINWALSERTAL BERGBAHNEN to facilitate the issuing and processing of a season or annual ticket.
I have been informed that my personal data collected for the above-mentioned purposes will be collected, processed and stored for up to three years beyond the season, in compliance with the provisions of data protection law.
